Terms of Service

1. Acceptance of Terms

By accessing or using any product or service provided by QRK Tech LLC ("QRK Tech," "we," "us," or "our"), including but not limited to Profile Magician ("Profmage") and the associated web portal, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Services

QRK Tech provides software-as-a-service (SaaS) tools for IT professionals. Our current offerings include:

• Profile Magician (Profmage) — A Windows user profile migration tool distributed as a standalone executable, with an optional cloud management portal.

3. Account Registration

To use certain features, you must create an account via our web portal. You agree to provide accurate information and maintain the security of your account credentials. You are responsible for all activity under your account.

4. Licensing

Profile Magician uses a per-machine licensing model. Each new account receives 10 free licenses. Additional licenses may be purchased through the portal. A license is consumed when a migration is successfully initiated on a unique device (identified by its hardware ID). Licensed machines can be re-run unlimited times at no additional cost.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any QRK Tech software.
• Redistribute, sublicense, or share license keys with unauthorized parties.
• Use the services to violate any applicable laws or regulations.
• Attempt to circumvent licensing, authentication, or security mechanisms.
• Interfere with or disrupt the services or servers.

6. Data and Privacy

Our collection and use of data is described in our Privacy Policy. By using our services, you consent to such collection and use.

7. Cloud Configuration Security

When using cloud-managed job configurations, sensitive data (including domain credentials) is encrypted client-side using AES-256-GCM before being transmitted to our servers. QRK Tech does not have access to your configuration password or the decrypted content. You are solely responsible for maintaining the secrecy of your configuration passwords.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. QRK TECH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL DEFECTS WILL BE CORRECTED.

Profile migrations involve system-level operations. You acknowledge that you are responsible for maintaining backups and that migrations may not preserve all data (e.g., passwords stored in the Windows credential store or browser password vaults are not migrated).

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QRK TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.

10. Modifications

We may update these Terms from time to time. Continued use of the services after changes constitutes acceptance. We will notify registered users of material changes via email or portal notification.

11. Termination

We may suspend or terminate your access to the services at our discretion if you violate these Terms. Upon termination, your right to use the services ceases immediately. Licenses already consumed remain valid for their licensed devices.

12. Governing Law

These Terms are governed by the laws of the State in which QRK Tech LLC is organized, without regard to conflict of law provisions.
